These Terms of Service (“Terms”) govern your access to and use of the website located at privatelending.llc(the “Site”), operated by Private Lending LLC (“Private Lending,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

Private Lending is a private, or “hard money,” lender. We make business-purpose loans to real estate investors for the acquisition, renovation, or refinancing of investment property. We do not make consumer loans and do not offer loans for personal, family, or household purposes. All financing is intended for experienced investors and business entities acquiring or improving property for business or investment purposes.

1. No Offer or Commitment to Lend

The information on the Site is provided for general informational purposes only. Nothing on the Site is an offer, commitment, or promise to lend, to extend credit, or to enter into any transaction. Loan products, rates, terms, and availability are subject to change without notice and depend on the specific property, transaction, and borrower. Any loan is subject to our underwriting review, credit and property evaluation, applicable law, and the execution of definitive written loan documents. No loan terms are binding unless and until set forth in a signed written agreement.

2. Not Financial, Legal, or Tax Advice

Content on the Site — including any calculators, articles, or examples — is for general information only and is not financial, investment, legal, tax, or accounting advice. You should consult your own qualified professionals before making any decision. Any figures or estimates are illustrative and not a guarantee of results.

10. Indemnification

You agree to indemnify and hold harmless Private Lending and its members, managers, employees, and agents from any claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Site or your violation of these Terms.

11. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws principles. You agree that any dispute arising from these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Virginia, and you consent to their jurisdiction.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
